RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISKS

1. DEFINITION OF "RELEASEES"

In this agreement, the term "Releasees" shall include Goblins Martial Arts Academy Ltd, its owners, directors, officers, employees, instructors, agents, independent contractors, representatives, and the owners of the premises located at 204 Island Hwy N, Courtenay, BC.

2. ACKNOWLEDGMENT OF INHERENT RISKS

I, the undersigned, understand that Brazilian Jiu Jitsu (BJJ), Muay Thai, Wrestling, Self Defence, and General Martial Arts training involve intense physical contact. I acknowledge that the risks include, but are not limited to:

• Physical Injuries: Bruises, sprains, torn ligaments, broken bones, and joint dislocations.

• Severe Injuries: Concussions, neck/spinal injuries, or cardiovascular distress.

• Infections: Skin infections (staph, MRSA, ringworm) common in contact sports.

• Submission Techniques: Risks associated with "chokeholds" and joint locks.

3. WAIVER OF LIABILITY AND RELEASE

In consideration of being allowed to train, I hereby agree to release and discharge the Releasees from any and all claims, demands, or causes of action resulting from NEGLIGENCE or any other fault. This includes, but is not limited to, injuries arising from:

• Instruction, training, or "rolling" (sparring) provided by staff or contractors.

• The use of the facility, mats, or equipment.

• Negligence on the part of the Releasees to safeguard me from the risks of the activity.

4. MEDIA RELEASE AND CONSENT

I understand that the releasees regularly take photos or video throughout the year. I will notify the releasees via email to info@goblinsmartialarts.com if I do not want to be photographed. If you do not want to be photographed all reasonable efforts will be taken to ensure that I am not in the background of images.  I hereby grant the Releasees the irrevocable right and permission to photograph, video record, and/or audio record me (or my child) during classes, seminars, or events. I agree that:

• These materials may be used for promotional, marketing, or educational purposes (including social media, website, and print).

• I waive any right to compensation or ownership of these materials.

• I release the Releasees from any claims of defamation, invasion of privacy, or infringement of moral rights.

5. MEDICAL FITNESS GOVERNING LAW

I certify that I am in physically fit condition to participate in martial arts and have no medical impairments that would prevent my safe participation. I agree to:

• Maintain high standards of personal hygiene to prevent the spread of skin infections.

• Immediately stop training and notify an instructor if I feel dizzy, ill, or injured.

• Strictly follow the "Tap Out" rule to ensure the safety of myself and my training partners.

6. INDEMNIFICATION & GOVERNING LAW

I agree to indemnify and hold harmless Goblins Martial Arts Academy Ltd against any and all claims, suits, or actions of any kind whatsoever for liability, damages, or costs (including legal fees) brought by me or anyone on my behalf.

This agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction.
